Affiliate Terms and Conditions:

The Affiliate Terms and Conditions apply to any purchased products from Exercise 2B Fit, LLC. By joining as a sales partner you agree to be bound by and accept the following terms and conditions. Filling out the form to create a profile and submitting it to Exercise 2B Fit is considered acceptance of the affiliate terms and conditions. These terms and conditions are subject to change without prior written notice at any time, at Exercise 2B Fit’s sole discretion.

Exercise 2B Fit pays a 10% referral fee for each sale that you refer to Exercise 2B Fit from your website, your blog, email, or any offline marketing.   A sales partner’s sole compensation under these terms and conditions shall be a commission computed as follows: 10% of actual payments received by Exercise 2B Fit due to your sales and 25% on the commissions paid to sales partners that you brought in to the affiliate program.

Note that the 25% on the sales partners you bring into the affiliate program is on the commissions that they earn and NOT the sales that they make.

The actual payment which all sales partners will receive their commissions on does not include payments on discounts, taxes or shipping and handling. The actual payments are only for the sale price of the products received in cash. If Exercise 2B Fit does not receive payment for the merchandise or the merchandise is returned and payment credit back to the customer, NO commission will be paid.

For actual payments that have been received and the customer has not asked for a refunded.   A check will be sent to the sales partners when the commission amount reaches $100 dollars.   If at any time after a commission is paid and there is a refund issued on the sale for which that commission was paid, the commission must be refunded to Exercise 2B fit or amount will be removed from the sales partner’s next commission payment. All commission payments due will be mailed on the first of every month.

Below is a scenario to better help you understand the process. For this scenario, the first sales partner (parent) is you and the second and third sales partners (children) are the people you brought in the affiliate program.

Scenario:

Sales Partner (parent) has two sales partners (children):

1.     Sales Partner (parent) has $1000 worth of sales for the month.

2.     The first sale partner (child) has $250 in sales for the month.

3.     The second sales partner (child) has $750 in sales for the month.

The commission calculation would work as follows:

Step 1 - Sales partner (parent) - $1000 x 10% = $100

Step 2 - Sales partner (child 1) - $250 x 10% = $25 x 25% = $6.25

Step 3 - Sales partner (child 2) - $750 x 10% = $75 x 25% = $18.75

Step 4 - Sales Partner (parent) commission = $100 + $6.25 + $18.25 = $125.

The above commission is equal to or over $100 dollars and will be paid to the sales partner (parent) on the first of the next month.

The terms described above are known as “Plan 1.” You should select this plan from the dropdown box when you register to become a sales partner. Any other plan terms must be negotiated in writing and signed by the sales partner and the Exercise 2B Fit President.

You need to be a registered sales partner under our affiliate program to be able to access the resources of our Partner Zone.

The sales partner registration form allows you to provide details for your sales partner profile. The fields marked by the red asterisk sign (*) are mandatory for completion. To submit the completed registration form, click the Submit button at the bottom of the form.

If the registration is successful, you will be notified about it by a message appearing at the top of the screen.

Please be aware that we require a moderated partner registration policy. That means registration requires that a partner profile is approved by the store administrator before you actually become a partner. So you will not be able to login to the Partner zone immediately after submitting the registration form.

You will have to wait for a notification to be sent to your email address in which you will be informed that your partner profile has been approved (you will not be able to login to the Partner Zone until the approval is issued). The approval process usually takes less than one hour.

The information you need to understand how the Partners Zone works will be found in the Sales Affiliate User Manual. Once you are inside the Partner Zone, just click on the link called “Partner Files” to download the manual. Also, note that all other sales and marketing materials will be accessible from this link. For example, marketing flyers to help you promote and sell Exercise 2B Fit products can be downloaded and printed from this area. On these flyers there will be a place for you to add your sales partner code, so when the code is used by your referred customer they will get a discount on their purchase and you will get a commission on the sale. The current discount rate for customers using your sales partner’s code is 10%. This is subject to change without notice at Exercise 2B Fit’s sole discretion.

You will be able to find all information about your commissions and the sales related to them in the Partners Zone.

Your agree not to modify, publish, copy, transmit, participate in the transfer or sale of, create derivative works of, or in any way exploit, in whole or in part, any copyrighted material without proper authorization.

THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Indemnification:

You agree that you shall indemnify and defend Exercise 2B Fit and all parties from whom Exercise 2B Fit has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms and Conditions or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into products that were not part of the standard Website Content.

Limitation of Liability:

IN NO EVENT SHALL EXERCISE 2B FIT OR ITS LICENSORS, SUPPLIERS, OR VENDORS, THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR FOR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT EXERCISE 2B FIT HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SITE OR OF FAILURE TO PROVIDE PRODUCTS OR SERVICES THAT YOU ORDER FROM EXERCISE 2B FIT OR ITS AFFILIATES, INCLUDING WITHOUT LIMITATION, DAMAGES ARISING FROM MISTAKE, OMISSION, VIRUS, DELAY, OR INTERRUPTION OF SERVICE.
